2. Applicability

These terms and conditions apply to every offer from Devstate and to every agreement established between the entrepreneur and the customer.

3. The offer

Devstate offers services in the field of web design and development ("Websites as a Service"). All offers are free of obligation unless explicitly stated otherwise. Obvious mistakes or errors in the offer do not bind the entrepreneur.

4. The agreement

The agreement is established at the moment of acceptance by the customer of the offer and compliance with the conditions set therein.

5. Right of withdrawal

Upon delivery of services, the consumer has the option to dissolve the agreement without giving any reason for at least 14 days, commencing on the day of entering into the agreement. Note: If the execution of the service has begun with the customer's consent before the end of the withdrawal period, this right does not apply. For B2B customers, there is no right of withdrawal.

6. Prices and payment

The stated prices are in Euro and exclusive of VAT, unless otherwise stated. Payment must be made within the period indicated on the invoice (standard 14 days). In case of late payment, the customer is legally in default and statutory interest is due.

7. Duration transactions: duration, cancellation and extension

Agreements for a definite period (e.g., annual subscription) cannot be cancelled prematurely unless agreed otherwise. Termination of a subscription must be done in writing or by email observing a notice period of one month before the end of the term.

8. Liability

Devstate is not liable for damages resulting from the use of the delivered services unless there is intent or gross negligence. Liability is in any case limited to the amount of the invoice value of the relevant service.

9. Intellectual property

Unless otherwise agreed, Devstate retains all intellectual property rights to the designs, code, and concepts developed by it. The customer obtains a right of use for the duration of the agreement.

10. Complaints and disputes

Complaints about the execution of the agreement must be submitted to Devstate within a reasonable time, fully and clearly described. Only Belgian law applies to agreements between the entrepreneur and the customer.
